Visa fee w.e.f. 01 September 2017

IMPORTANT NOTICE

A separate ICWF (Indian Community Welfare Fund) account is now being fully operational w.e.f 01.12.2015. Following are the ICWF charges for the various services provided (i.e Visa, Passport, OCI & misc services etc.).

Both the Bank drafts/Postal Orders should be in favour of the Indian Embassy.

ONLINE VISA APPLICATION

ALL VISA APPLICANTS ARE REQUIRED TO FILL IN AND SUBMIT THEIR VISA APPLICATION FORMS ONLINE. THE FORM CAN BE ACCESSED HERE A PHOTOGRAPH IS ALSO REQUIRED TO BE UPLOADED AFTER FILLING IN THE ONLINE APPLICATION FORM. EACH APPLICATION SUBMITTED ONLINE  WILL GENERATE A UNIQUE WEB FILE NUMBER STARTING WITH THE LETTERS 'IRLD...'.A PRINTOUT OF THE APPLICATION USING THE WEB FILE NUMBER, AFTER ONLINE SUBMISSION ALONGWITH ALL THE REQUIRED DOCUMENTS LISTED BELOW UNDER THE TYPE OF VISA APPLIED FOR, IS THEN TO BE SUBMITTED TO THE EMBASSY BY THE APPLICANT IN PERSON OR THROUGH A REPRESENTATIVE OR BY POST / COURIER.  THE PRINTED PHOTO TO BE SUBMITTED WITH THE APPLICATION FORM SHOULD BE THE SAME AS THE PHOTO UPLOADED. APPLICATIONS SUBMITTED ONLINE WILL REMAIN IN THE SYSTEM FOR 3 WEEKS WITHIN WHICH IT HAS TO BE SUBMITTED AT THE  EMBASSY WITH ALL THE SUPPORTING DOCUMENTS. IF NOT, APPLICANTS WILL HAVE TO REAPPLY ONLINE. APPLICANTS MAY NOTE THE WEB FILE NUMBER TO TRACK THE STATUS OF THEIR APPLICATION PROCESS ONLINE BY CLICKING ON 'VISA ENQUIRY' IN THE LINK FOR THE APPLICATION FORM.

NO APPOINTMENT IS REQUIRED TO BE SCHEDULED TO SUBMIT THE APPLICATIONS IN PERSON. APPLICANTS CAN VISIT THE EMBASSY BETWEEN 0930-1200 HRS ON ANY WORKING DAY TO SUBMIT THEIR APPLICATIONS. NORMAL PROCESSING TIME FOR VISAS IS BETWEEN 5-7 WORKING DAYS FROM DATE OF ACCEPTANCE OF THE APPLICATION IN THE EMBASSY. VISAS CAN BE PROCESSED IN TWO WORKING DAYS IN EMERGENCIES FOR IRISH PASSPORT HOLDERS ONLY, UPON PAYMENT OF AN ADDITIONAL FEE OF EURO 50/- PER VISA OVER THE NORMAL VISA FEE. PROCESSING TIME COULD BE MORE IN EXCEPTIONAL CASES REQUIRING ADDITIONAL DOCUMENTS / CLARIFICATIONS / INTERVIEWS.

THE EMBASSY HAS STARTED ISSUING VISAS IN A NEW FORMAT STICKER WITH PHOTOGRAPH OF THE APPLICANT. THIS VISA DOES NOT REQUIRE A SIGNATURE OF THE CONSULAR OFFICER EVEN THOUGH THERE IS A PROVISION FOR THE SIGNATURE IN THE VISA STICKER.

OTHER INFORMATION ABOUT INDIAN VISAS

  • All visas are valid from the dates of their issue. Tourist visas are valid for a period of six months and transit visas are valid for one month with stay up to 72 hours on each transit, All other visas are valid for the period they are issued based on the requirement of the applicant and the discretion of the Embassy.

  • Visa applications can be submitted in the Consular Section of the Embassy between 0930-1200 hrs and collected between 1600-1700 hrs on all working days.

  • Applications for visas can also be sent and received back through Post. For return of passports by Post, applicants should provide the Embassy with a self addressed registered envelope at the time of applying for the visa. 

  • Normal Visa processing time taken is between 5-7 working days. This may be more in cases where additional documents/clarifications or interviews are involved. The time taken does not include time in Post or weekends/holidays.

  • Visas can be granted within two working days in emergencies. However, this facility is available only for citizens of Ireland upon their payment of an additional charge of €50/- over the admissible visa fees for the service.

  • When self-addressed registered returned envelope is not sent together with visa application, applicant is required to collect passport/visa from the Embassy after 7 working days from the date of dispatch of the application.  Before collecting visa, applicant is advised to check visa application status online to ensure that visa is ready for collectin.  Online visa application status is available on the following website :https://indianvisaonline.gov.in/visa/VisaEnquiry.jsp.  Visa can be collected either personally by the applicant or by third party on presentation of authorisation letter signed by the applicant.

  • No visa is required for transit passengers who take their connecting flight from within the airport without entering any Indian city. However, a transit visa will be required in case the transit involves clearing and recheck-in of baggage on another airline if the bagage is not booked to its final destination as this will involve clearing Immigration before proceeding to the departure area to re-check in the baggage for taking the onward flight. Travellers are advised to confirm the requirement with the airline at the time of booking their tickets. 

  • Acceptance of visa application does not automatically guarantee grant of a visa.

  • Visa processing fee once deposited shall not be refunded. Fee should be deposited only after ascertaining the correct type and period of visa applicable for the purpose of visit.

  • The duration and number of entries granted to the applicant will be solely at the discretion of the Embassy. No claims and correspondences shall be entertained in this regard.

  • Visa applications from those who are not citizens of Ireland will be accepted only if they are resident in Ireland, (Two years for Business visa applicants). Proof of residence in the form of utility bills or Bank statements should accompany such visa applications.

  • Foreign nationals in Ireland having stay permit less than two years should apply for employment visa from their home countries.

  • All applicants should check the details in their visas, immediately after collection, and bring any discrepancies to the notice of the Consular staff without delay for clarification / rectification. If not, the Embassy will not bear any responsibility thereafter.

  • Satellite telephone services like Thuraya and Irridium are not permitted in India. TCL (Tata Communications Limited) is permitted to provide Inmarsat services in India only after a no objection certificate is issued by the Department of Telecommunications (DOT) on a case to case basis. Unauthorised use of satellite telephone services will be prosecuted under section 6 of Indian Wireless Act and section 20 of Indian Telegraph Act.

Tourist Visa

Persons wishing to visit India as tourists, or for meeting friends and relatives, will be given six months tourist visas. Tourist visas are non-extendable and non-convertible. Double or multiple entry tourist visas should be applied for if the applicants wish to also travel to neighbouring countries and return through India. 

Documents required

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background. 

  • Visa Application form duly filled in and signed.

  • Applications of children of Indian origin, have to be signed by both parents if the child(ren) are to travel alone or with only one parent. 

  • Visa fees -Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Business Visa

Business Visa is granted to a foreign national who wants to visit India to establish an industrial/ business venture, to explore possibilities to set up industrial/business venture, to purchase/sell industrial products or visit the Indian offices of their companies for business meetings, setting up facilities, training etc. Non-Irish passport holders may please note that Business visa can be considered in their case only if they have been resident in Ireland for the past two years. Proof of such residence (in the form of utility bills or Bank statement - one of two years back date and another recent) should be submitted along with the application and other documents listed below. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

Documents required

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background.

  • Visa Application form filled in and signed.

  • Additional form (for Business visa applicants only)

  • A signed letter from the employer in Ireland introducing the applicant with details of his designation, passport etc and stating nature of his visit to India, its duration, number of visits envisaged etc.

  • A signed letter of invitation from the Indian entity which the applicant will visit on its letterhead stating the purpose, duration and number of visits for which visa is required.

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favourin

  • Utility bill or Bank statement  - one dated two years back and another recent (with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Journalist Visa

Granted to professional journalists, photographers, television and film crew. Visa is granted for a period up to three months. Journalists and photographers are granted only Journalist visa irrespective of the purpose of their visit. Those going on long term residential assignments to India may contact the Embassy for visa application.  

Documents required

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent 5x5 cm-size photographs taken against a plain light colored or white background..

  • Visa Application form filled in and signed.

  • Letter from the employer / TV or other Media House stating the purpose of travel.

  • Letter from Indian entity with whom the foreign media will collaborate or use assistance of for the filming.

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

  • Film crew will be required to furnish a synopsis of the film / documentary or new item they will be filming with the details of places they will visit, seperate letters giving names of crew with their passport details, list of equipment imported into India for the filming, detailed itinerary for the duration of filming etc..

  • Special permits will be required for filming in archaeological, heritage and restricted sites.

  • Any other document(s) as may be required on a case to case basis.

Student Visa

Student visas are granted to bona fide students to pursue regular studies at recognized institutions in India and to persons going for studying Yoga, Vedic Culture, Indian systems of dance/music etc at recognised and designated Cultural Institutions. The visa is valid for the period of study as approved by the educational/recognized institutions in India. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

Students sponsored by AIESEC for project based work in companies/industries are eligible for business visa and those going for community/social services will be granted entry visa.

Documents required

  • Original Passport to cover duration of course

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background.

  • Visa Application form filled in and signed.

  • Letter of admission from a recognised Indian educational institution clearly stating the name of the course, its duration and fees charged including (board and lodging) including for courses like yoga, Vedic culture, Indian dance & Music

  • Document showing financial support for the tuition fee and stay in India.

  • No objection letter from Parents of applicant to study abroad for applicants below 18 years

  • Visa fees - - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Conference visa

Conference Visas are granted to applicants on production of an  invitation to an International conference /seminar/workshop being organized in India by a Ministry or Department of the Government of India; public sector undertaking; central educational institution; public funded universities; organizations owned and controlled by the Government of India/State Government/Union Territory/United Nations or its specialized agencies. The organisers of the conference etc are required to obtain prior clearances from nodal/line Ministry concerned of the Central/state governments, the Central Ministries of Home and External Affairs. These approvals are to be conveyed to the Embassy and to the applicants who should include them with their applications

  • Original Passport valid for a minimum of 180 days with at least two blank pages

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background.

  • Visa Application form filled in and signed.

  • A copy of the signed Letter of Invitation for the Conference from organizers in India.

  • A copy of the letter from the Institution represented in Ireland.

  • Clearance letters from the Indian Ministries as indicated above.

  • Visa fees - - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Medical visa

A Medical visa is given for a medical treatment. Duration and number of entries of the visa will depend on the nature of illness and its treatment certified by the Indian consulting doctor. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

Documents required

  •  Original Passport valid for a minimum of 180 days with at least two blank pages.

  •  One recent 5x5 cm-size photograph taken against a plain light colored or white background..

  •  Visa Application form filled in and signed.

  •  Relevant letters signed and stamped from the hospital concerned in India and Ireland.

  •  Visa fees - - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  •  Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Medical Escort visa

A Medical Escort visa is given to those who are accompanying a patient. Maximum of two escorts are permitted with a patient. Visa is granted coterminous with the visa of the patient. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent passport-size photograph taken against a plain light colored or white background..

  • Visa Application form filled in and signed.

  • Letter from doctor/hospital certifying the requirement of an attendant.

  • Documents relating to the medical treatment of patient

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Research visa

Research Visas are granted for Research work for a maximum of three years or for the duration of the research project, whichever is earlier. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

Documents required

  • Original Passport valid to cover the duration of the research.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background..

  • Visa Application form filled in and signed..

  • Submission of subject of research along with the application

  • Original admission letter of recognized university. (emails or photocopies of admission letters will not be accepted

  • Evidence of financial resources. 

  • Visa fees - - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Transfer of long-term visa

For transferring a long term visa from an old passport to a new passport, applicants are required to submit the old passport which holds the valid Indian Visa and the current valid passport. Passport valid for a minimum of 180 days with at least two blank pages

Entry Visa

An Entry Visa is given for specific purposes such as

Indian origin applicants visiting relatives, voluntary / internship work, or for any other purpose not covered specifically under any of the other visa categories.  Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days.

Documents required

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background..

  • Visa Application form filled in and signed.

  • Invitation letter from the organization/agency based in India and a letter from the concerned institute in Ireland for persons going for voluntary work. For students letter from their institutions and letter of financial guarantee either from parents or Bank.

  • Applications of children of Indian origin have to be signed by both parents if the child(ren) are to travel alone or with only one parent. 

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).

Employment Visa

Employment visa is granted to a foreigner to take up an employment in India. Visa is granted for the duration of the employment or to a maximum period of two years whichever is less. Annual salary should not be less than USD 25000 per year. The employment will have to be subject to Income Tax as stipulated by the IT Act of India as applicable. Registration with Foreigners Regional Registration Office (FRRO) is required within 14 days of arrival in India if the stay is more than 180 days. Employment Visa will be considered only if an Indian Company is authorised by the Government of India to employ foreign nationals and will be only to specialised positions. Employment visa will be accepted at this embassy only from citizens of Ireland. Applicants of other nationalities will have to apply for their visa from the Indian Embassy in their country of origin.

Foreign nationals who wish to come to India for honorary work (without salary) with NGOs registered in India are granted employment visa for a one year duration. However foreign national can draw a monthly remuneration not exceeding Rs. 10000/- for honorary work. Further extension is done by the state governments/Union Territories/Foreigners Regional Registration Office, and Foreigner's Regional Registration Office.

In case of change in employer, a fresh employment visa will have to be applied for and obtained from the Indian Mission in their country of origin of the applicant.  

Documents required

  • Original Passport valid for the duration of the employment.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background..

  • Visa Application form duly filled in and signed.

  • Proof of employment in the form of detailed employment contract giving detailed terms and conditions of the employment by the company/organization etc. in India, which should be signed by both the employer and the applicant.

  • Letter of offer of employment from the Indian company.

  • Documentary proof of educational qualifications and professional expertise.

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • The express processing of this type of visa is not available. 

Project Visa

Project visa is granted to foreign nationals going to India for execution of projects in the power and steel sectors.

Documents required

  • Original Passport valid for a minimum of 180 days with at least two blank pages.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background. .

  • Visa Application form duly filled in and signed.

  • Letters from the employers of the applicant and the Indian company offering the employment

  • Employment contract with detailed terms and conditions

  • Visa fees  - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

Project visa will be accepted at this Embassy only from applicants who are citizens of Ireland. Applicants of all other nationalities should apply for their visa from the Indian Mission in their country of origin.

Transit Visa

A transit visa is granted to enable applicants to transit through India to destinations in other countries. The visa will be valid for entries within 15 days of date of issue for a maximum stay of 3 days on each transit. Transit visa is not required if a traveller will be transitting from within the airport. However, a transit visa will be required in case the transit involves clearing and recheck-in of baggage on another airline (as in the case of travel to Nepal, Srilanka etc) as this will involve clearing Immigration before proceeding to the departure area for taking the onward flight. Travellers are advised to confirm the requirement with the airline at the time of booking their tickets.

  • One recent 5x5 cm-size photograph taken against a plain light colored or white background.

  • Visa Application form duly filled in and signed.

  • Copy of confirmed air ticket for onward journey.

  • Visa fees - Payment is accepted only through postal order or Bank Draft favouring 'Embassy of India, Dublin'.

  • Recent utility bill or Bank statement with name and address of applicant printed on it for proof of residence in Ireland (only for non-Irish passport holders).


Important

Fee is payable by two separate crossed postal orders/bank drafts in Euros, drawn in favour of Embassy of India, Dublin and payable in Dublin for all consular services.  (i) One postal order/bank draft according to the respective category of visa/consular service required and (ii) another postal order/bank draft for €2/-(applicable to all categories).

For example if someone is applying for a single entry Tourist Visa the applicant will have to buy two separate postal orders/bank drafts, one postal order/bank draft amounting to €50/- and another postal order/bank draft for €2/

Gratis Visas

  • Afghanistan, Bangladesh, Democratic People's Republic of Korea, Jamaica, Maldives, Mauritius, Mongolia and South Africa. In respect of Seychelles nationals, all type of visas except for work/employment are gratis.

  • Only Business, Tourist and Transit visas are issued on gratis basis to nationals of Argentina, similarly only tourist visas are issued on gratis basis to the nationals of Uruguay. Normal visa fee is applicable for all other types of visas in respect of these nationals.

  • Transfer of Visa: Service fee of € 5 (An additional amount of €3/- for ICWF is charged along with all visa services)

  • An amount of €19 has to be added to the fee to be charged from US nationals for visa application form fee as directed by the Ministry.

  • Visa exempted nationalities: Nepal, Bhutan

  • Visa fees are based on reciprocity or inter - governmental agreement.

  • Fees are subject to change, as prescribed by the Government of India.

  • Fees are to be paid by a crossed postal order/bank draft in Euros, drawn in favour of Embassy of India, Dublin and payable in Dublin. Credit cards, cheques, cash, or payments in other currencies, are not acceptable.

  • Business and Employment visa to the applicants from Least Developed Countries (LDCs) will be issued on gratis basis, however ICWF fee of €3/- will be charged. The list of LDCs is attached below:

  • Singaporean Nationals: Tourist visa (Multiple entry), valid for up to six months € 24. Visa fee for all other types of visas is the same as applicable for other countries.

  • Japanese Nationals: €1 for transit visa and € 8 for all other types of visas

  • Pakistani Nationals: €2 for all types of visas.

  • Nigerian Nationals: Visa fee of € 238 for all types of visas.

  • USA Nationals: Tourist visa fee of € 95 for the maximum period up to 10 years. Fee for 10 years validity Business visa is € 238 as well as for five years. Fee for all other types of visas will be same as applicable for other countries. Visa application fee of € 19 will be charged from US nationals in addition to visa fees. However, the tourist visa fee of € 95 is inclusive of visa application fee.


FAQs on Visa Services

Business Visa

What is a Business Visa?

Business Visa is granted to a foreign national who wants to visit India to establish an industrial/business venture or to explore possibilities to set up industrial/business venture, or wants to purchase/sell industrial products in India. This Visa is granted subject to following conditions:-

(i) The applicant is a person of assured financial standing and expertise in the field of the intended business.

(ii) The applicant is not visiting India for the business of money lending or petty trading, or for a full time employment in India involving payment of salary in India etc.

(iii)The facility of Business Visa will also be extended to senior executives of firms, experts, tour conductors and travel agents, etc., visiting India in connection with work related to projects of national importance, including those undertaken by public sector undertakings, and conducting business tours of foreigners or business relating to it, etc.

(iv) A foreign national will have to comply with all other requirements like payment of tax liabilities etc.

(v)The grant of Business Visa is subject to any instructions issued by the Government of India on the basis of reciprocity with other foreign countries from time to time.

(v) The Business Visa must be issued from the country of origin, or from the country of domicile of the foreigner provided the period of permanent residence of that applicant in that particular country is for more than 2 years.

Who are eligible for a Business Visa?

(i)Foreign nationals who want to visit India to establish industrial/business venture or to explore possibilities to set up industrial/business venture in India

(ii)Foreign nationals coming to India to purchase/sell industrial products or commercial products or consumer durables.

(iii)Foreign nationals coming to India for technical meetings/discussions, attending Board meetings, general meetings for providing business services support.

(iv)Foreign nationals coming to India for recruitment of manpower.

(v)Foreign nationals who are partners in the Business and/or functioning as Directors in the company.

(vi)Foreign nationals coming to India for consultations regarding exhibitions, for participation in exhibitions, trade fairs, business fairs, etc.

(vii)Foreign buyers who come to transact business with suppliers/ potential suppliers at locations in India, to evaluate or monitor quality, give specifications, place orders, negotiate further supplies etc., relating to goods or services procured from India.

(viii)Foreign experts/specialists on a visit of short duration in connection with an ongoing project with the objective of monitoring the progress of the work, conducting meetings with Indian customers and/or to provide some high level technical guidance.

(ix)Foreign nationals coming to India for pre-sales or post-sales activity not amounting to actual execution of any contract or project.

(x)Foreign Trainees of multinational companies/corporate houses coming for in-house training in the regional hubs of the concerned company located in India (xi)Foreign students sponsored by AIESEC for internship on project based work in companies/industries

(xii) Foreign experts coming to India for imparting training for the personnel of the Indian company.

What is the duration of a Business Visa?

Business Visa with multiple entry facilities is granted for a period up to 5 years. A stay stipulation may be prescribed for each visit by the concerned Indian Mission.

Can foreign nationals coming to execute projects in India be granted Business Visas?

No. A foreign national coming for executing projects/contracts will have to come only on an Employment Visa.

Can foreign nationals already in India for executing projects on Business Visas extend their Business Visas?

No.

Can foreign nationals already in India for executing projects on Business Visas be allowed to convert their Business Visas to Employment Visas without leaving the country?

No

Which category of Visa will be granted to family members of foreign nationals coming to India on Business Visas?

Indian Missions may grant an ‘X’ Visa [i.e. a Dependent Visa] to the family members of a foreign national granted a Business Visa at their discretion, subject to usual security checks provided the family members are otherwise eligible for grant of such a Visa.

Employment Visa

What is an Employment Visa?

An Employment Visa (Specified 'E') may be granted to a foreigner subject to the fulfilment of the following conditions:-

(i) The applicant is a highly skilled/skilled and qualified professional or person who is being engaged or appointed by a company, organization, industry, or undertaking, etc. in India on contract or employment basis at a senior level, skilled position such as technical expert, senior executive, or in a managerial position, etc. 

(ii) Employment Visa should not be granted for jobs for which large number of qualified Indians are available. Furthermore, Employment Visa should not be granted for routine, ordinary or secretarial/clerical jobs.

(iii) The salary of the foreign national employed should not be less than Rs.16.25 lakhs per annum.

(iv) The foreign national should be coming for employment in companies registered in India. 

(v) In respect of foreign nationals engaged as teaching faculty at the level of assistant professor and above by the Central Higher Education Institutes the minimum salary limit for grant of employment visa is Rs.9.10 lakhs per annum 

(vi) The foreign national must hold a valid passport, and a re-entry permit if that is required under the law of the country of nationality of the applicant.

(vii) The foreign national should not be a persona-non-gratia to the Government of India.

(viii) The foreign national should not be an undesirable person and not the subject of a black list or any warning circular or other restrictive list.

(ix) The foreign national will have to comply with all other requirements like payment of tax liabilities etc.

(x) The foreign national must submit proof of his/her employment or contract or engagement by the company/organization, etc. in India.

(xi) The foreign national must submit documentary proof of his educational qualifications and professional expertise.

(xi) Foreign teaching faculty employed in South Asian University and Nalanda University will be exempted from minimum salary limit for the grant of employment visa. 

Who are eligible for Employment Visa?

Following categories of foreign nationals may be granted Employment visa subject to the fulfillment of the conditions mentioned above:-

(1) Foreign nationals coming to India as consultant on contract for whom the Indian company pays a fixed remuneration, (may not be in the form of monthly salary).

(2) Foreign artists engaged to conduct regular performances for the duration of the employment contract given by Hotels, Clubs, other organizations.

(3) Foreign nationals who are coming to India to take up employment as coaches.

(4) Foreign sportsmen who are given contract for a specified period by the Indian Clubs/organizations.

(5) Self-employed foreign nationals coming to India for providing engineering, medical, accounting, legal or such other highly skilled services in their capacity as independent consultants.

(6) Foreign language teachers/interpreters.

(7) Foreign specialist Chefs.

(8) Foreign engineers/technicians coming to India for installation and commissioning of equipments/machines/tools in terms of the contract for supply of such equipment/machine/tools.

(9) Foreign personnel deputed for providing technical support/services, transfer of know-how, services supplies for which the Indian company pays fees/royalty to the foreign company.

What is the duration of an Employment Visa?

An Employment Visa will be valid for entry and stay into India within the period of its validity unless specified otherwise and subject to conditions specified. Validity of an Employment visa will be as specified below: 

(i) A foreign technician/expert coming to India in pursuance of a bilateral agreement between the Government of India and the foreign government, or in pursuance of a collaboration agreement that has been approved by the Government of India, may be granted an Employment visa for the duration of the agreement, or for a period of five years, whichever is less with multiple entry facilities.

(ii) A foreigner coming to India for employment not covered in (i) above (and also other than those being employed in IT software and IT enabled sectors) may be granted Employment visa with a validity up to two years or the term of assignment, whichever is less with multiple entry facility. 

(iii) In the case of highly skilled/skilled foreign personnel being employed in the IT software and IT enabled sectors, the Missions/Posts may grant visa with validity up to 3 years or the term of assignment, whichever is less with multiple entry facility.

(iv) In case of Employment Visa issued for a period of 180 days or less, registration is not required with FRRO/FRO. The Missions/Posts may issue multiple entry Employment Visas for a period of 180 days or less. 

(v) However, if the Employment visa is valid for a period of more than 180 days, it should carry an endorsement to the effect that the E-visa holder must register with the FRRO/FRO concerned within 14 days of arrival. 

(vi) FRRO/FRO concerned may issue Residential Permit on registration for the validity of the visa period. However, if there is any change in the residential address, the foreign national concerned should immediately report the change of address to the FRRO/FRO concerned. (It may be mentioned that at present the Residential Permit is granted by the FRRO/FRO concerned for a period of one year only and the foreign national has to get this extended every year from the FRRO/FRO concerned).

(vii) The Employment visa can be extended by the State Governments/UT Administrations/FRROs/FROs beyond the initial visa validity period up to a total period of 5 years from the date of issue of the initial Employment Visa on year to year basis subject to good conduct, production of necessary documents in support of continued employment, filing of Income Tax returns and no adverse security inputs about the foreigner. The period of extension shall not go beyond five years from the date of issue of the initial Employment visa.

Whether a foreign company/organization that does not have any Project Office/subsidiary/joint venture/branch office in India can sponsor a foreign national/employee of a foreign company for Employment Visa?

Ans. No.

Whether an Indian company/organization which has awarded a contract for execution of a project to a foreign company that does not have any base in India, can sponsor employee of foreign company for Employment Visa?

Ans. Yes.

If the Indian organization/entity sponsors an Employment Visa, does this mean that the Indian organization/entity has to necessarily be the legal employer of the person?

Ans. No.
